ATLANTA – The U.S. District Court for the Northern District of Georgia has issued an order in the Auction Management Solutions, Inc. (AMS) v. Manheim and Live Global Bid (LGB) and AMS v. ADESA patent infringement lawsuits, establishing the meanings of important patent claim terms at issue in the cases. This action started in 2005, when AMS filed a patent infringement lawsuit against automobile auction giant Manheim Auctions, Inc., Live Global Communications USA, Inc., and LGB. After considering briefs and the parties’ arguments, Judge Richard W. Story issued a 67-page order interpreting certain patent claim terms selected by the parties. This order marks an important milestone in the litigation and sets the stage for the upcoming jury trial.
“We are gratified that the court, in its ruling, has validated the strength of our patent and our positions in this litigation. Given the impact this ruling will have on the merits of these cases, we are eager to proceed to a jury trial,” commented Nancy Rabenold, AMS’ president and CEO.
Although a trial date has not yet been set, Story previously indicated an intention to set the date shortly after issuing his claim construction ruling.
